Free Sale Certificate

Companies exporting products from the United States are often asked by foreign governments or customers to supply a "Certificate" as a required part of the process to import a product into their country. The most commonly requested certificate is the “Free Sale Certificate”.

The law of the United States does not require a “Free Sale Certificate” for the export of cosmetic products, although most importing foreign countries require it. It is the responsibility of members to follow the U.S. laws and regulations, and know the cosmetics requirements of the countries to which they export. ACMA does not issue certificates for drugs or medical devices. Persons requesting a cosmetic certificate have the responsibility to ensure that their products are cosmetics as defined under U.S. law.

What is Cosmetic?

Cosmetic products which encompass the realm of hair care, skin care, oral care, toiletry, perfumery and makeup are all used in our daily routines to keep us healthy and attractive. The term "cosmetic" means articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering the appearance, and articles intended for use as a component of any such articles; except that such term shall not include soap ( Soap is defined in the Code of Federal Regulations at 21 CFR 701.202 ).

Cosmetics History

The first archaeological evidence of cosmetics usage is found in Egypt around 3500 BC during the Ancient Egypt times with some of the royalty having make up such as Nefertiti, mask of Tutankhamun, etc. The Ancient Greeks and Romans] also used cosmetics. The word “cosmetics” comes from the Greek word kosmetikos meaning “skilled in adornment”. The evolution of cosmetics has truly changed through the centuries. The way people wear makeup and the reasons why they wear it have changed dramatically over time.
